Resumo
O artigo apresenta as linhas gerais da recuperação judicial no direito brasileiro a partir da evolução histórica dos mecanismos legais de prevenção da falência, desde a menção à recuperação de empresas no Código Comercial de 1850 e a introdução da concordata preventiva pelo Decreto nº 917/1890, passando pelas reformas de 1908 e 1929 e pelo Decreto-Lei nº 7.661/1945, com as concordatas preventiva e suspensiva, até a Lei nº 11.101/2005, que extinguiu a concordata e instituiu a recuperação judicial e a extrajudicial. Com base no art. 47 da lei vigente, o texto examina os objetivos do instituto, notadamente a preservação da empresa, a proteção dos trabalhadores e a redução do custo do crédito, e conclui que a recuperação judicial confere credibilidade aos jurisdicionados, embora reclame maior rigor na fiscalização dos prazos, das suspensões de assembleias de credores e da atuação dos auxiliares do juízo.

Abstract
An outline of judicial reorganization in Brazilian law
The article outlines judicial reorganization in Brazilian law through the historical evolution of the legal mechanisms designed to prevent bankruptcy, from the reference to business recovery in the 1850 Commercial Code and the preventive composition introduced by Decree No. 917/1890, through the 1908 and 1929 reforms and Decree-Law No. 7,661/1945, to Law No. 11,101/2005, which abolished the old composition with creditors and created judicial and out-of-court reorganization. Based on article 47 of the current statute, it examines the goals of the institute, namely the preservation of the business, the protection of workers and the reduction of the cost of credit, and argues that stricter oversight of extended deadlines, suspensions of creditor meetings and the work of court-appointed officers is needed.
